Serbian lawyer Čedomir Stojković has filed a criminal complaint for terrorism against Milan Radoicić and his group over the attack in Banjska in northern Kosovo. Stojković is a lawyer who calls for Serbia to move closer to the West.
He has made several legal arguments that Milan Radoicic’s group should be judged a terrorist group
“All “paramilitary groups” outside the formal state structure are terrorist groups under the laws of the Republic of Serbia, especially if they are heavily armed and want to use violence to make policy.” Any (non-state) use of force to implement a policy is terrorism. And any such group is a terrorist group. Milan Radoicic’s group is a terrorist group.”
A convoy with full weapons can pass without stopping and without control through the land security zone, namely through the border of Serbia with Kosovo ONLY and exclusively if the head of the Serbian security services has given an order for that armed convoy to be allowed to pass. It is the most secured territory in Serbia, where anti-terrorist units, special forces and the Serbian army are constantly stationed. We can test this: let’s start with 25 vehicles in a convoy on the same road as Milan Radoicic’s group and see how far they would get. (We would have already been arrested in Novi Pazar),” says Stojković.
Lawyer Stojković says he also filed a criminal complaint against those officials who gave weapons to the terrorist group and stopped them only when they crossed the border into Kosovo.
“The seized weapons are military weapons (anti-tank mines, mortar shells, anti-tank missile systems, the production and distribution of which is under the control of the Republic of Serbia. Without the help and organization of the top forces of the Serbian security services, no such equipment could have come into the hands of this group from Serbian warehouses and factories. Nor could it have obtained a HIMARS missile or a Javelin system without the consent and support of the U.S. Government. Supporting Milan Radoicic’s group with weapons helps terrorism. And this is exactly what the highest officials of the NN of the Security Services of Serbia did. For this reason, they were included in the criminal charges.”
According to Stojković, Aleksandar Vučić participated in the organization of paramilitary groups in the 1990s and gained experience there. He argues the existence of the terrorist group with this.
“The era of paramilitary groups in Europe had to die together with Slobodan Milosevic, who in the nineties, together with Voijslav Sešelj, created such paramilitary groups to operate in Croatia and Bosnia and Herzegovina. These groups were formally outside the service of Slobodan Milosevic and informally dependent on Belgrade, which armed and supplied them with logistics. So it is now with Milan Radoicic’s group. Aleksandar Vučić, as a student and pupil of Voijslav Sešelj, participated in the organization of paramilitary groups in the 1990s and gained experience and positive thoughts about them there. Therefore, today there is a paramilitary organization of Serbia in the north of Kosovo, as Belgrade did in Bosnia and Herzegovina and Croatia. Unfortunately, we know how badly it ended on both sides.”
“These paramilitary organizations committed many atrocities and war crimes in the 1990s. “After the fall of Slobodan Milosevic, all these “paramilitary organizations” are terrorist organizations according to the laws of Serbia,” says the Serbian lawyer.
According to Stojković, Serbia’s refusal to treat Milan Radoicic’s group in this way proves that Serbian authorities are cooperating with him.
“Today’s release of Radoicic, after he spent less than 24 hours in detention in Belgrade, completes this picture.”
He added that Serbia has a duty under the law to suppress terrorism.
“This duty exists not only under the laws of Serbia, but also under international agreements and conventions. If Serbia refuses to suppress this terrorism and instead supports and aids terrorist groups, Serbia could be expelled from many international organizations as well as many EU programs.”
Everyone in the West (but also most in the East) clearly recognizes the Banjska group as a terrorist organization, he says, adding that Serbia’s refusal to recognize the group and treat it as a terrorist group clearly expresses to the West that it is a group formed from Belgrade.
“The only way for Serbia to escape the fate of the 1990s and preserve any potential for negotiations is to immediately arrest and detain all members of this group.” Only by immediately arresting all members of this group can Serbia show that the activities of this group do not reflect Serbia’s policy. If Serbia does not arrest the members of this group, it will show that this group is implementing the policy of Serbia and that Milan Radoicic has acted in accordance with the policy of Belgrade. And this is a simple and obvious legality that would clearly lead to sanctions.
Stojković said that such a criminal complaint should have been filed by the Serbian state authorities.
