The Russian Ministry of Foreign Affairs, in a statement carried by the Sputnik portal and numerous media outlets in Serbia, again misinforms, claiming that the recognition of Kosovo's independence in 2008 was a "flagrant violation of international law" and that the West uses "double standards."
The Russian Ministry of Foreign Affairs emphasizes:
"One of the first symptoms of this disease was the recognition of Kosovo's independence by several Western countries, led by the United States, in 2008.
Thus, a flagrant precedent of violation of the fundamental norms and principles of international law was created, "First of all, the UN Charter," Sputnik Serbia reports.
Situation analysis:
Kosovo's declaration of independence on 17 February 2008 was not in breach of international law. The International Court of Justice (ICJ) has ruled that the general system of international law does not contain a prohibition on unilateral declarations of independence and that the the declaration does not violate the UN General Charter.
Over 110 United Nations member states, including the United States and most European Union countries, have recognized Kosovo as an independent state.
The International Court of Justice on July 22, 2010 declared that the recognition of Kosovo is not a violation of international law, which directly denies Russia's claim that Kosovo constitutes an "illegal precedent" for the West.
Before declaring independence, Kosovo was under international administration by the United Nations, according to UN Security Council Resolution 1244, following the war and humanitarian crisis of 1999.
This means that Kosovo had a special international legal regime, different from the internal territorial issues of other countries.
While Moscow claims to defend the territorial integrity of states, it recognizes breakaway territories in Georgia and Ukraine and uses the rhetoric of self-determination only when it suits it.
This is an indication that the Russian position on Kosovo is not a legal analysis of stable, but a geopolitical stance.
