After Slovenia imposed sanctions on SNSD President Milorad Dodik, the illegally elected government of the Republic Srpska (RS) convened
They announced that they were protesting against what they claimed was a unilateral and politically motivated decision to ban Milorad Dodik from entering the Republic of Slovenia.
They therefore decided to ban Slovenian President Nataša Pirc Musar and Deputy Prime Minister and Minister of Foreign Affairs Tanja Fajon from entering this entity of Bosnia and Herzegovina.
“In order to protect the political and institutional integrity of the Republika Srpska, the Government of the Republic Srpska, in accordance with international practice, is taking reciprocal measures and imposing a ban on entry into the Republic Srpska on Nataša Pirc Musar, President of the Republic of Slovenia, and Tanja Fajon, Deputy Prime Minister and Minister of Foreign and European Affairs in the Government of the Republic of Slovenia,” the statement reads.
The Ministry of Internal Affairs was instructed to prevent them from entering the territory of the RS entity and, if they were staying in the RS, to escort them outside the borders of that entity.
However, it is important to note that, in accordance with the Constitution of Bosnia and Herzegovina and the Law on Movement and Residence of Foreigners, only the state of Bosnia and Herzegovina has the authority to approve or deny entry to foreign citizens.
This means that the entities, namely the RS and the Federation of Bosnia and Herzegovina, do not have the authority to independently regulate issues of international relations or border control.
It is already known that the powers of the entities relate to internal matters, but not to diplomatic matters and the movement of foreigners.
The entities may tell a diplomat that he is not welcome, but they cannot prevent him from entering the territory of the entity if BIH has granted him entry.
